Terms of Service

These Terms of Service (“Terms”) govern your access to and use of 1300.ai, operated by 1300.ai (“we”, “our”, or “us”). By creating an account or using the platform you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. The Platform
1300.ai is an online directory and learning management platform connecting consumers with local businesses across Australia, currently focused on the pool and spa industry. The platform includes:
- A searchable directory of business listings.
- A Learning Centre offering free and paid industry courses.
- Premium listing features for businesses, including AI avatar technology and staff training tools (Platinum plan).
2. Accounts
You must be at least 18 years old and a resident or business operating in Australia to create an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately at dw@platform5ive.co if you suspect unauthorised access.
You may not create accounts for others without their permission, impersonate any person or entity, or provide false information during registration.
3. Business Listings
3.1 Unclaimed listings
We may create unclaimed listings for businesses based on publicly available information. These listings are provided as a convenience to consumers. If you are the owner or authorised representative of a listed business you may claim it by following the verification process on the platform.
3.2 Accuracy of listing information
When you claim or update a listing you represent that all information provided is accurate, current, and that you are authorised to act on behalf of the business. You agree to keep your listing information up to date.
3.3 Prohibited listing content
You must not include in a listing:
- False, misleading, or deceptive information.
- Content that infringes any third party’s intellectual property rights.
- Discriminatory, offensive, defamatory, or illegal content.
- Spam, unsolicited promotions, or links to malware.
- Information about services you are not licensed to provide.
We reserve the right to remove or edit any listing content that violates these Terms, at our sole discretion and without notice.
4. Enquiries
The enquiry feature allows consumers to contact businesses through the platform. By submitting an enquiry you consent to your name, email, phone number, and message being shared with the business you are contacting. We are not a party to any transaction or agreement that results from an enquiry and accept no responsibility for the conduct of businesses or consumers.
5. Reviews
Reviews submitted through 1300.ai must reflect genuine first-hand experiences with the business. You must not:
- Submit reviews for businesses you have a financial interest in or work for.
- Submit fake, incentivised, or defamatory reviews.
- Submit multiple reviews for the same business.
All reviews are subject to moderation before publication. We may remove reviews that violate these Terms or appear fraudulent. By submitting a review you grant us a non-exclusive, royalty-free, perpetual licence to display it on the platform.
6. Subscriptions and Payments
6.1 Plans
We offer the following subscription plans for business listings:
- Standard: free, basic listing.
- Featured: A$49/month — enhanced visibility and analytics.
- Platinum: A$149/month — all Featured features plus AI avatar and staff LMS.
All prices are in Australian dollars and are inclusive of GST where applicable.
6.2 Billing
Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing you authorise us to charge your payment method on a recurring basis until cancellation. Failed payments may result in immediate downgrade to the Standard plan.
6.3 Cancellation and refunds
You may cancel your subscription at any time via the Billing section of your dashboard. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not provide pro-rata refunds for partial months, except where required by Australian Consumer Law.
6.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law that cannot lawfully be excluded or limited.
7. Courses and Learning Centre
Course content is provided for educational purposes only and does not constitute professional, legal, or safety advice. Completion of a course does not confer any professional licence or certification unless explicitly stated in the course description. You are responsible for verifying that any regulatory requirements applicable to your situation are met through appropriate licensed professionals.
Course access is personal and non-transferable. You must not share login credentials or course content with others.
8. AI Avatar (Platinum Plan)
The AI avatar feature is powered by Unith. The responses generated by the avatar are based on the knowledge base you provide and are not verified by us. You are solely responsible for ensuring the accuracy of information in your avatar’s knowledge base and for any representations made by the avatar to your customers. We are not liable for any loss arising from inaccurate or misleading avatar responses.
9. Intellectual Property
All platform content created by us — including the design, code, text, graphics, and trademarks — is owned by 1300.ai and protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
You retain ownership of content you upload (listing photos, business descriptions, course knowledge base material). By uploading content you grant us a worldwide, royalty-free licence to display and distribute it on the platform for the purpose of providing the services.
10. Prohibited Conduct
You must not:
- Attempt to gain unauthorised access to any part of the platform or another user’s account.
- Use automated tools (scrapers, bots, crawlers) to extract data from the platform without our written consent.
- Interfere with or disrupt the platform’s infrastructure or security.
- Use the platform for any unlawful purpose.
- Resell, sublicence, or commercially exploit any part of the platform without our consent.
11. Termination
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or if required by law. On termination your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including payment obligations, intellectual property, and limitation of liability) will survive.
12. Disclaimers
The platform and all content are provided “as is” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses. We do not verify the credentials, licences, or qualifications of any business listed on the platform — you should conduct your own due diligence before engaging a service provider.
13. Limitation of Liability
To the maximum extent permitted by law, 1300.ai and its directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of (or inability to use) the platform, including loss of profits, data, or goodwill. Our total aggregate liability to you for any claim arising out of or related to these Terms or the platform will not exceed the amount you paid to us in the three months preceding the claim, or A$100, whichever is greater.
14. Indemnity
You agree to indemnify and hold harmless 1300.ai and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the platform, your content, or your violation of these Terms.
15. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be handled by a court of competent jurisdiction in Australia.
16. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
